From checking the debt to recovery

We review the contract, due date, correspondence, acknowledgements of debt and any partial payments. On that basis, we prepare notices and represent the creditor in negotiating payment terms.

If court proceedings are needed, we prepare the claim and present the evidence under the applicable procedure. Where an enforceable title exists, we assist in dealings with the judicial enforcement officer and represent clients in enforcement disputes.

Can a loan be recovered without a written agreement?

Without a written agreement, other evidence and the applicable evidential rules must be examined. Bank statements, messages and other records may be relevant, but whether the loan can be proved depends on the individual case.

Which documents are useful for the first consultation?

The agreement, if any, proof of transfer or delivery of the money, correspondence and records of repayments. Include any notices and court documents already received.

Does a partial payment by the debtor matter?

Partial payments and messages acknowledging a debt may affect the assessment of evidence and limitation periods. We check the content and date of each record alongside the agreed repayment date.
