For bidders

We review procurement documents, qualification requirements and contractual terms to identify participation obligations and risks. We prepare requests for clarification and advise on bid documents, consortium agreements and subcontracting arrangements.

We assess procurement terms and decisions taken during the procedure, as well as the reasons for rejection given with the outcome. For each decision we check the available remedy and when the time limit begins; a problem in the procurement documents may require action before bids are evaluated. We prepare challenges and appeals and represent clients before the National Council for Solving Complaints (CNSC) and the competent courts.

For contracting authorities

We assist with preparing and reviewing procurement documents, drafting contractual terms and responding to clarification requests. We address legal issues arising during bid evaluation and provide representation in challenges and litigation.

Our legal contribution is coordinated with the assessments of technical and financial specialists, respecting each participant’s responsibilities and conflict-of-interest rules.

Contract performance and public partnerships

We assist parties with performance obligations, contract amendments, payments and disputes arising during performance. We also advise on public-private partnerships under their specific legal framework.

Which documents are needed for a procurement challenge?

The procurement documents, clarifications, the bid or its relevant parts, the award notification or challenged decision, and proof of notification. These enable us to assess the grounds, deadline and available remedy.
